Terms of Use
Last updated:
These terms apply to everyone who uses GigCalm, whether you are booking an artist or listing yourself as one. By creating an account or making a booking you agree to them. If you do not agree, please do not use the service.
1. What GigCalm is
GigCalm is a website where clients find DJs, musicians, bands and singers (“artists”), see their services and prices, and book a date directly with them.
GigCalm (“we”, “us”) runs the platform. We are not an agency, we do not employ or represent the artists, and we are not a party to the agreement between a client and an artist. We do not promise that any artist will be available, that an event will go ahead, or how a performance will turn out.
2. Accounts
To book you need an account with an email address and a password, and a client profile: either a private person or a company. Where phone confirmation is switched on, you also need to confirm your phone number with a code.
- You must be at least 18 years old, or have a parent or guardian's permission and be able to take responsibility for the booking.
- What you give us must be true and kept up to date. Do not use someone else's name, phone number or company details.
- Keep your password to yourself. What happens under your account is your responsibility until you tell us it was used without your permission.
- One person, one account.
3. Booking an artist
Each artist sets their own services, durations, prices and working hours. When you book, you choose a service and a free time; the booking appears in the artist's calendar. Depending on the artist, it is confirmed at once, or it is a request that holds the time until the artist confirms or declines it, usually within 24 hours; if nobody answers, the request is cancelled and the time released. You receive an email at each step.
Prices on the site are shown for information. You do not pay through GigCalm and we do not take a commission. Payment, any deposit, the contract and the details of the event are agreed directly between you and the artist, and they are what binds you, not this page.
Please book only what you mean to attend. Repeated bookings that are not honoured can lead us to limit or close your account.
4. Cancelling
Every artist sets a cancellation deadline, a number of hours before the start. Until it passes you can cancel yourself from My bookings. After it passes, please contact the artist directly: once you are signed in, the artist's page shows their email and, if the artist has turned it on, a WhatsApp button, and the booking confirmation offers a WhatsApp message with the booking details (also only if the artist has turned it on).
An artist can cancel a booking and must give a reason, which we pass on to you by email. An artist can also mark a booking as a no-show when the client did not come.
Cancelling here does not by itself cancel or settle anything you agreed with the artist outside the site, such as a deposit or a signed contract.
5. For artists
An artist's page is public. What you put on it is your responsibility:
- Your name, description, services, prices and dates must be accurate, and you must keep your calendar up to date so clients do not book time you cannot give.
- You must have the right to use every photo, logo, text and recording you add. Music and video can be added only as links to YouTube, SoundCloud or Mixcloud; their own terms apply to them.
- You are responsible for your own licences, performance and music rights, insurance, tax and invoices. The contract and offer builders in the studio are drafting aids and do not replace legal advice.
- Treat clients' details, which you see in order to carry out a booking, only for that booking.
You keep all rights to your content. By adding it you allow us to show it on GigCalm and in the emails and pages that belong to your bookings.
6. Fair use
Do not use the service to break the law, to harass or mislead anyone, to make false bookings, to collect other people's details, or to disturb or get around the service (for example automated scraping, or probing for weaknesses).
7. Price of the service
Using GigCalm is currently free for clients. We plan a paid subscription for artists in the future. If we introduce one we will announce it in advance, and nothing is charged to an artist without their agreement. We will never take a commission on bookings.
8. Suspending an account or a page
We may hide an artist's page, stop new bookings or close an account that breaks these terms or the law, or that puts others at risk. Existing bookings and data are kept, and we will tell you why when we can.
You can stop using the service at any time and ask us to delete your account (see the Privacy Policy).
9. Our content
The GigCalm name, logo, design and software are ours or our licensors'. You may use the site for its purpose; you may not copy or resell it.
10. Responsibility
The service is provided as it is and as available. We work to keep it running and accurate, but we cannot promise that it will always be free of errors or interruptions.
To the extent the law allows, we are not responsible for what happens between a client and an artist, for an artist who is late, does not come or performs badly, for an event that goes wrong, or for indirect loss. Nothing in these terms limits a liability that cannot be limited by law, including for harm caused intentionally.
11. Changes
We may update these terms. The date at the top shows when they last changed. If a change is significant we will tell registered users by email or on the site. Using the service after a change means you accept it.
12. Law and courts
These terms are governed by the laws of the State of Israel, and the competent courts in Israel have sole jurisdiction, without affecting any right you have as a consumer under mandatory law.
